This Privacy Policy explains how Netrium Technologies LLC ("Netrium," "Brandcaster," "we," "us," or "our") collects, uses, and shares information when you use brandcaster.ai, our mobile applications, and related services (collectively, the "Service"). By using the Service, you agree to this Policy.
2. Information We Collect
We collect information from you directly, automatically through your use of the Service, and from third parties.
2.1 Information you provide
Account information: name, email, password, and optional company/organization name.
Brand and business data: logos, brand assets, fonts, colors, guidelines, product information, and similar materials you upload or provide.
Prompts and instructions: text and inputs you submit for generation or automation features.
Generated content ("Outputs"): images, videos, text, and other results created through the Service.
Communications: support messages, feedback, survey responses, and other correspondence.
2.2 Content you upload or create
User Content: logos, brand assets, product images, creatives, and other materials you upload, store, or create using the Service.
Associated metadata: file type, size, timestamps, and identifiers needed to organize your workspace.
2.3 Information collected automatically (web and mobile)
Usage data: IP address, device/browser type, pages or screens viewed, session duration, clickstream data, referring URLs, feature interactions, and error logs.
Log and diagnostics data: crash logs, performance metrics, and system activity used for reliability and security.
Approximate location: inferred from IP address (not precise GPS location).
2.4 Information from third parties
Depending on features you use, we may receive:
Authentication data: if you sign in via third-party login providers (e.g., basic profile info such as email).
Payment and subscription data: purchase status, subscription state, transaction identifiers, and entitlement information from app stores and/or payment processors (we do not receive or store full payment card numbers).
Social media integration data: if you connect accounts for publishing/scheduling, we receive the tokens/permissions and related publishing actions needed to provide those features.
Infrastructure and security data: signals from service providers used for hosting, storage, analytics, logging, fraud prevention, and customer support.
3. How We Use Information
We use information to:
Provide, operate, and maintain the Service
Authenticate you and secure accounts
Generate content and manage your brands, assets, and Outputs
Process payments and manage subscriptions/credits
Provide customer support and communicate about the Service
Monitor performance, debug issues, and prevent abuse/fraud
Comply with legal obligations and enforce our Terms of Service
Improve and develop the Service, including using aggregated or de-identified data where appropriate
4. User Content, Uploaded Images, Outputs, and AI Processing
4.1 How we use User Content and Outputs
You may upload logos, brand assets, product images, and other materials ("User Content"). We use User Content and Outputs to:
provide and improve the Service,
generate Outputs you request,
store and organize your brand library,
maintain safety and prevent abuse,
comply with legal obligations.
We do not sell your User Content.
4.2 AI providers and model training
To provide AI functionality, third-party AI providers may process prompts, User Content, and related inputs to generate Outputs.
Training/retention: Some AI providers state that data submitted via certain business/API offerings is not used to train models for other customers by default; however, this depends on each provider's terms and may change. 5. Third-Party Services
We use third-party service providers to deliver and improve the Service, such as:
Cloud hosting, databases, and authentication
Cloud storage providers (to store and serve User Content, including uploaded brand assets and media, and generated Outputs)
AI model providers
Payment processors and app stores
Analytics, logging, and crash reporting
Email delivery and customer support tools
Social media publishing/scheduling integrations
These providers may process information on our behalf under contractual terms. We are not responsible for the privacy practices of third parties' own services, and their processing may be governed by their privacy policies.
6. How We Share Information
We may share information:
With service providers who process data on our behalf
For legal and safety reasons (e.g., to comply with law or protect rights and safety)
In business transfers (e.g., merger, acquisition, financing, or asset sale)
With your direction or consent (e.g., publishing actions you initiate, or case studies/public galleries if you opt in)
No sale / no cross-context behavioral advertising: We do not sell personal information for money, and we do not share personal information for cross-context behavioral advertising.
7. Cookies and Tracking Technologies
7.1 Website
We may use cookies, local storage, and similar technologies to remember settings, keep you signed in, support security, and analyze usage. You can control cookies via browser settings and any cookie controls we provide. Disabling certain cookies may affect functionality.
7.2 Mobile app
The mobile app does not use browser cookies. It may use local device storage and SDKs for session management and diagnostics.
7.3 App tracking
We do not use cross-app tracking identifiers for advertising unless we clearly disclose it and, where required, request permission (e.g., via platform prompts).
8. Mobile App Permissions
The mobile app may request access to:
Camera: to capture photos of your products, brand assets, and other media for content creation
Photo Library (Read): to select and upload existing images and videos from your device for brand assets and content creation
Photo Library (Write/Save): to save generated content, outputs (images, videos, creatives), and exported materials back to your photo library
You control these permissions through your device settings. Denying access to camera or photo library will limit certain features (such as capturing new product photos or saving generated content), but you can still use other parts of the Service.
9. Purchases and Subscriptions
If you purchase subscriptions or credits:
Web: transactions are processed by payment processors; we receive purchase status and account entitlements, not full card details.
Mobile (App Store): the app store (and any purchase management platform we use) processes the transaction; we receive subscription/entitlement status and transaction identifiers, not payment card details.
10. Data Retention
You can delete your account in the mobile app. We retain information only as long as necessary to provide the Service, comply with legal obligations, resolve disputes, enforce agreements, and maintain security.
Typical retention periods (may vary based on legal requirements and operational needs):
Account information: retained while your account is active and then deleted or de-identified within a reasonable period after account deletion, unless longer retention is required by law or for security/fraud prevention
User Content and Outputs: deleted following account deletion within a reasonable period, unless you choose to keep certain materials, or retention is required by law or for security/fraud prevention
Usage logs and diagnostics: generally retained for a limited period for security and operational purposes (commonly ~90 days to 1 year)
Payment and transaction records: retained as required by tax/accounting laws (commonly up to ~7 years)
Deleted data may persist in encrypted backups for a limited period before being purged.
11. Security
We use reasonable technical and organizational measures to protect information, including access controls and monitoring. User Content (including uploads) is stored with third-party infrastructure providers to provide the Service. No system is completely secure, and we cannot guarantee absolute security.
12. Your Rights (GDPR, CCPA/CPRA, and Other Laws)
Depending on your jurisdiction, you may have rights to:
access, correct, delete, or obtain a copy of your personal information,
object to or restrict certain processing,
withdraw consent where processing is based on consent,
opt out of certain disclosures where applicable,
not be discriminated against for exercising your rights.
How to exercise rights: Email privacy@netriumtechnologies.com. We may verify your identity before fulfilling certain requests. We respond within the timeframes required by applicable law.
12.1 Legal basis (where GDPR applies)
Where GDPR applies, we process personal information based on one or more of: performance of a contract, legitimate interests (security, fraud prevention, improving the Service), consent (where required), and legal obligations.
12.2 Account deletion (in-app)
You can delete your account directly in the mobile app. Account deletion will remove access to your account and delete (or de-identify) personal information, User Content, and Outputs associated with your account, subject to the retention practices described in Section 10 (for example, legal compliance, dispute resolution, security, and backups).
13. International Transfers
Information may be processed in the United States and other countries where we or our providers operate. Data protection laws may differ by jurisdiction.
14. Children's Privacy
The Service is intended for users 13 or older. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided personal information, contact privacy@netriumtechnologies.com and we will take appropriate steps.
15. Changes to This Policy
We may update this Policy from time to time. The updated version will include a revised "Last updated" date. Continued use of the Service after changes take effect means you accept the updated Policy.
